- The Strategy: It is imperative to exhaustively document dismissal grounds and ensure internal regulations are up-to-date and approved by the Ministry of Labor (MITRADEL).
Compensation Strategies and Non-Monetary Benefits
Facing inflationary pressure and talent competition, companies are diversifying remuneration packages beyond base salary. However, implementing "benefits in kind" or "emotional salary" carries tax and labor risks if not structured correctly.
It is legally vital to distinguish between what constitutes salary (calculable for benefits and severance) and non-salary benefits, to avoid future liabilities with the Social Security Fund or during labor settlements.
