La Superintendencia de Sujetos No Financieros (SSNF) ha modificado el proceso administrativo sancionatorio en materia de prevención del blanqueo de capitales, el financiamiento del terrorismo, y el financiamiento de la proliferación de armas de destrucción masiva, (“Proceso Administrativo Sancionatorio”), el cual es aplicable a los siguientes sujetos obligados no financieros:
- Empresas de la Zona Libre de Colón, empresa establecidas en Panamá Pacífico, Zona Franca Barú, y demás zonas francas establecidas en Panamá.
- Casinos, juegos de azar y organización de sistemas de apuestas y otros establecimientos físicos o telemáticos que desarrollan estos negocios a través de internet.
- Empresas promotoras, agentes inmobiliarios y corredores de bienes y raíces, cuando estos se involucren en transacciones para sus clientes de compra y venta de bienes inmobiliarios.
- Empresas dedicadas al ramo de la construcción, empresas contratistas generales y contratistas especializadas.
- Empresas de transporte de valores.
- Casas de empeño.
- Empresas dedicadas a la comercialización de metales preciosos o a la comercialización de piedras preciosas.
- Empresas dedicadas a la compra y venta de autos nuevos y usados.
- Notarios públicos.
- Abogados y contadores siempre y cuando realicen las actividades listadas en la Ley No.23-2015.
El Procedimiento Administrativo Sancionatorio dará inicio cuando el Informe de Supervisión realizado por la SSNF evidencie incumplimientos a la regulación, Las sanciones de carácter pecuniario dependerán la gravedad del incumplimiento, y pueden variar desde US$ 30,000 hasta US$ 1,000,000.
De igual manera, la SSNF podrá aplicar de manera inmediata sanciones de entre US$ 5,000 hasta US$ 10,000 en caso de que el sujeto obligado no envié, o envié de forma tardía, la información o documentación requerida, o la presente incompleta o ilegible, o si incumple con el requerimiento de registro ante dicho regulador.
Para los efectos de este procedimiento de sanción inmediata, los abogados o firmas de abogados que actúen como agentes residentes serán multados de manera distinta, es decir, con multas por un valor de US$1,000.00 hasta de US$10,000.00 por cada persona jurídica cuya información no mantengan registrada o actualizada, y/o por cada información falsa que proporcionen sobre los beneficiarios finales de las personas jurídicas
La SSNF publicará a través de su página web las sanciones impuestas, indicando nombre del sujeto obligado no financiero, y el tipo y monto de la sanción.
Es de suma importancia que todas las empresas señaladas arriba tomen nota de sus obligaciones y se aseguren que cumplan con las mismas para evitar las multas señaladas.
The Superintendence of Non-Financial Subjects (SNFS) has modified the administrative sanctions process related to the prevention of money laundering, terrorist financing, and financing for the proliferation of weapons of mass destruction, applicable to the following non-financial reporting entities (“Administrative Sanctions Process”):
- Companies established in the Colon Free Zone, in the Panama Pacifico Agency, in the Baru Free Zone, and other free zones established in Panama.
- Casinos, gambling games and organizations of betting systems and other physical or telematic establishments that develop these businesses through the internet.
- Property developers, real estate agents and real estate brokers, when these are involved in buying and selling real estate transactions for their clients.
- Construction companies, general contractors and specialized contractors.
- Securities transport companies.
- Pawnshops.
- Companies engaged in the marketing of precious metals or in the marketing of precious stones.
- Companies engaged in the purchase and sale of new and used cars.
- Notaries public.
- Lawyers and accountants if they carry out the activities listed in the Law No.23-2015.
The Administrative Sanction Process will begin when the Supervision Report issued by the SNFE evidences non-compliance with the regulation. The penalties of a pecuniary nature will depend on the severity of the non-compliance and can vary from US$ 30,000 up to US$ 1,000,000.
Likewise, the SNFE may immediately apply sanctions in the range of US$5,000.00 to US$10,000.00, in the event that the reporting entity does not send, or sends late, the information or documentation required, or that such is incomplete or illegible, or if it fails to comply with the registration requirement with said regulator.
For the purposes of this immediate sanction imposition process, attorneys or law firms acting as resident agents will be fined differently, that is, fines in the amount of US$1,000.00 up to US$10,000.00 for each legal entity whose information they do not keep on record or up to date, and/or for each false information they provide about the ultimate beneficiary owners of the legal entities.
The SNFE will publish through its website the sanctions imposed, indicating the name of the non- financial reporting entity, and the type and amount of the sanction.
It is of the utmost importance that all legal entities listed above take note of their obligations and ensure their compliance with them in order to avoid the sanctions indicated.
